This Privacy Policy sets forth the privacy principles that FKA Brands follows with respect to personal information transferred from the European Union (EU) to the United States and is in accordance with the agreed upon framework (the “Privacy Shield Framework”) between the US Department of Commerce and the European Commission. Why we collect personal information

When you shop with FKA Brands, we receive information about you:

FKA Brands collects and uses your personal information to give you superior customer service, to provide you with convenient access to our products and services, and to make a wider range available to you. How we collect personal information

We collect information about you in several ways. For example, we ask for your contact information when you correspond with us or ask to be included in an email mailing list. We collect and store the information you provide in a secure database.

Our Ellia App requires that you allow us access to your camera and photos. The Ellia App captures an image and deletes the image captured within the amount of time it takes the App to recognize the color from your surroundings and match it to the mood light on your Ellia Aroma Diffuser, generally several seconds.

When we disclose personal information

Your personal information may be shared with other FKA Brands business units. They will protect your personal information in accordance with the FKA Brands Customer Privacy Policy.

FKA Brands also works with other companies that help us provide products and services to you, and we may provide your personal information to these companies. For example, we give shipping companies this information so they can deliver your refills or replacement products efficiently. The information they receive is for shipping and delivery purposes only, and we require that the companies safeguard your personal information in accordance with our policies.

Our website uses Secure Sockets Layering (SSL) to encrypt your personal credit information, including your credit card number, before it travels over the Internet. SSL technology is the industry standard for secure online transactions.

FKA Brands is responsible for all transfers of Personal Information to third parties in accordance with the EU-U.S. Privacy Shield Principles through legally-binding contracts. Any Personal Information transferred to a third party for data processing is processed in accordance with the contract, and is subject, by law, to a comparable level of protection as that provided by FKA Brands.

FKA Brands will conduct compliance audits of its relevant privacy practices to verify adherence to this Policy. Any employee that FKA Brands determines is in violation of this policy will be subject to disciplinary action up to and including termination of employment. FKA Brands will conduct an annual review to ensure adherence to the Privacy Shield framework requirements and complaint handling procedures.

Collecting other personal information

When you browse the FKA Brands web sites, you are able to do so anonymously. Generally, we don't collect personal information when you browse - not even your email address. Your browser, however, does automatically tell us the type of computer and operating system you are using.

Like many web sites, the FKA Brands web sites use "cookie" technology. When you first connect to our site, the cookie identifies your browser with a unique, random number. The cookies we use do not reveal any personal information about you. We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising. Certain Homedics products, mobile applications, and online services collect and process health and wellness information to provide and support health-related features.

Depending on the Homedics products and services you use, we may collect health and wellness information, including age or date of birth, height, weight, body composition measurements (such as body mass index (BMI), body fat percentage, body water, skeletal muscle percentage, bone mass, basal metabolic rate, muscle mass, and similar measurements), activity, exercise, sleep habit, nutrition, wellness goals, progress information, self-reported health information, wellness preferences, and device information necessary to connect compatible products and synchronize measurement data.

Certain information may constitute health data or special category personal data under applicable law.

How We Collect Health Information

We collect health information from sources: (i) information you provide through our products, mobile applications, or online services; (ii) measurements collected from compatible connected devices; and (iii) health metrics that are calculated or derived from those measurements.

Consent

Where required by applicable law, we obtain your consent before collecting or processing your health information. Consent is obtained through an affirmative action, such as accepting applicable terms during account registration, acknowledging an in-app notice, selecting a consent option, or taking another action indicating your agreement to the collection and use of your health information. How We Use Health Information

We use health information to provide and maintain our products and services; record, display, and analyze health and wellness measurements; personalize health insights, recommendations, reminders, and goal tracking; synchronize data between compatible devices and your account; provide customer support; troubleshoot technical issues; improve our products and services; and perform analytics using aggregated or de-identified information where permitted by law.

Legal Basis for Processing

Where required by applicable law, including the GDPR and UK GDPR, we process health information based on your explicit consent or another lawful basis permitted by law. If you withdraw your consent where consent is the basis for processing, certain health-related features may no longer be available.

For California residents, we collect, use, and disclose health information and other sensitive personal information in accordance with applicable California privacy laws, including the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA").

Sharing Health Information

We do not sell health information or use it for cross-context behavioral advertising.

We disclose health information only as necessary to provide our products and services, as authorized by you, or as otherwise permitted or required by applicable law. We may disclose health information to service providers that process information on our behalf to support our products and services, including providers of cloud hosting, data storage, analytics, technical support, and customer support. If you authorize the integration of your account with a third-party health platform, such as Apple Health, Health Connect, Fitbit, or similar services, we will share the health information necessary to provide the requested integration or synchronization.

Protection and Retention of Health Information

We maintain administrative, technical, and organizational safeguards designed to protect health information. We retain health information only for as long as necessary to provide our products and services, comply with legal obligations, resolve disputes, and enforce our agreements. Subject to applicable law, you may request deletion of your account and associated health information by contacting us or using the account management features available through our products or services.
